Privacy Policy

1. Who we are and what this policy covers
Athlesiure Inc dba Sun Diego Boardshop ("Sun Diego," "we," "us") is a California corporation located at 1330 Specialty Dr, Suite A, Vista, CA 92081. We sell surf, skate and lifestyle apparel and gear online at sundiego.com and in our stores in Pacific Beach, Mission Beach (Belmont Park), La Jolla (Westfield UTC), Carlsbad and San Clemente.
This policy explains what personal information we collect, how we use and share it, and the choices and rights you have. It applies to sundiego.com, our online store, our loyalty program, and information you give us in our stores. It does not cover third-party websites we link to, such as Afterpay or social media sites, which have their own policies.

2. Information we collect
Information you give us
- Orders and checkout: name, email, phone number, shipping and billing address, items purchased, and order history. Payments are processed by Shopify Payments, Shop Pay, Afterpay and our other payment processors. We do not store full card numbers.
- Customer accounts: name, email, sign-in details (stored by Shopify), saved addresses and order history.
- Contact form: name, email, phone number and your message.
- Email and text sign-ups: your email address and, if you choose to sign up for text messages, your mobile number.
- Loyalty program: name, email, phone number if you provide it, purchases and points balance, whether you sign up online or in a store.
- Returns, exchanges and chat: order details, the reason for your return, and anything you type into our chat or support messages.
- In our stores: information you give at checkout or when joining the loyalty program, such as your name, email and purchases.
Information collected automatically when you use our site
- Device and browser details, IP address and approximate location (city or region derived from IP).
- Pages and products viewed, searches, items added to your cart, and how you arrived at our site (for example, from an ad or a search engine).
- Identifiers stored in cookies and similar technologies, described in section 4.
Information from others
- Payment and financing providers (for example, whether an Afterpay or Shop Pay payment was approved).
- Advertising and analytics partners, such as which ad you clicked before visiting.
- Social media platforms, if you interact with our pages or ads there.
We do not knowingly collect sensitive personal information as defined by California law, such as government ID numbers, precise geolocation, or health information. Full payment card details go directly to our payment processors.
3. How we use information
- Process and ship orders, handle returns and exchanges, and provide customer support.
- Run your account and the loyalty program, including tracking points and issuing rewards.
- Send order updates, and marketing emails or texts if you have signed up. You can unsubscribe at any time.
- Operate, secure and improve the site, including preventing fraud and spam (for example, with hCaptcha on our contact form).
- Understand how visitors use the site and which products and pages perform well.
- Show Sun Diego ads on other websites and apps, and measure whether those ads work. Section 5 explains how this counts as "sharing" under California law and how to opt out.
- Comply with legal obligations and enforce our Terms of Sale.
4. Cookies and tracking technologies
We and our providers use cookies, pixels and similar technologies to run the store, remember your cart, understand site use, and advertise. These are the providers used on sundiego.com:

When you first visit, a cookie banner lets you accept or decline non-essential cookies, or manage your preferences by category. For visitors in California and other US states, analytics and advertising tools may run when you first arrive until you decline. You can change your choice at any time from the Your Privacy Choices link in the site footer. Blocking cookies in your browser may stop parts of the site, such as the cart, from working.
5. How we share information
We do not sell your information for money. We share it in these ways:
- Service providers who run parts of our business for us under contract and may use it only to provide their service: Shopify (e-commerce platform and hosting), payment processors and Afterpay, shipping carriers, Mailchimp and Mailmunch (email), Redo (returns and chat), our loyalty program provider, hCaptcha, and the other functional providers in section 4.
- Advertising and analytics partners, namely Google and Meta. When their tools run on our site, they receive identifiers, device details and what you view or buy. They may use this for their own purposes, such as improving their ad services. Under California law, this counts as "selling" or "sharing" personal information for cross-context behavioral advertising, even though no money changes hands. See section 6 to opt out.
- Shopify Network Intelligence: Shopify uses customer information from our store, combined with other Shopify data, to improve its products, ad targeting and personalization for our store. No other merchant can see your data.
- Legal and safety reasons: to comply with law, respond to lawful requests, protect our rights, or prevent fraud.
- Business transfers: if Sun Diego is involved in a merger, sale or similar transaction, information may transfer as part of it.
We do not knowingly sell or share the personal information of anyone under 16.
Our relationship with Shopify. Our store is hosted by Shopify, which processes personal information to provide and improve the store. Where Shopify uses information from our store together with information from other merchants for its own enhanced features, Shopify is responsible for that processing, including answering your rights requests about it. 6. Your choices
- Cookie choices: use the cookie banner, or the Your Privacy Choices link in the footer, to decline analytics and advertising cookies on this browser. You do not need to give us your name or email to do this.
- Opt out of sale or sharing: besides the cookie setting above, you can submit an opt-out request on our Do Not Sell or Share My Personal Information page to apply the choice to information linked to your email, such as your customer account and orders.
- Global Privacy Control: if your browser sends a Global Privacy Control (GPC) signal, we treat it as a request to opt out of sale and sharing for that browser and, if we can link the browser to your customer account, for your account as well.
- Do Not Track: browsers' older "Do Not Track" setting has no agreed standard, so we do not respond to it. We do honor GPC as described above.
- Marketing emails and texts: use the unsubscribe link in any email, or reply STOP to any text message. We will still send order and account messages.
- Your account: you can review and update your account details by signing in at sundiego.com/account.
7. California privacy rights
If you are a California resident, the California Consumer Privacy Act (as amended by the CPRA) gives you the rights below. This section is also our notice at collection.

We use sensitive personal information only to provide your account, not to infer characteristics about you, so we do not offer a separate "limit" link.
Your rights
- Know and access: ask what personal information we have about you and get a copy.
- Delete: ask us to delete it, subject to exceptions such as completing orders and legal record-keeping.
- Correct: ask us to fix inaccurate information.
- Portability: ask for a copy of your information in a format you can take to another company.
- Opt out of sale and sharing: see section 6.
- No discrimination: we will not deny you goods, charge different prices or give lower quality service because you used these rights.
How to make a request

- For opting out only, use the cookie banner, the Your Privacy Choices link, GPC, or our Do Not Sell or Share page.
We will confirm receipt within 10 business days and respond within 45 days (up to 90 days if we tell you we need more time). To verify your identity, we will ask you to confirm information we already hold, such as your email address and a recent order number. An authorized agent may submit a request for you with your signed permission, and we may ask you to verify your identity directly.
Complaints and appeals: if we deny your request, you can ask us to reconsider by replying to our response. You can also contact the California Privacy Protection Agency at cppa.ca.gov.
Loyalty program (notice of financial incentive)
Our loyalty program is free. Members earn 1 point per dollar spent at Sun Diego and 2 points per dollar on Sun Diego brand products, including sale items, and receive a $5 voucher for every 100 points. To run it, we collect your name, email, phone number if you provide it, and purchase history. We value this information at roughly the value of the rewards we issue, about 5% to 10% of qualifying spend, based on the program's cost to us. Joining is optional; you can sign up online or in any store, and you can leave at any time by contacting us, which ends point earning.
Shine the Light: we do not share personal information with third parties for their own direct marketing purposes as defined by Cal. Civ. Code 1798.83.
8. How long we keep information
We keep personal information only as long as we need it for the purposes above, using these criteria:
- Orders and transactions: for as long as required for tax, accounting and warranty purposes.
- Customer accounts and loyalty membership: while your account or membership is active, and for a reasonable period after you close it or it becomes inactive.
- Contact form, chat and support messages: for as long as needed to resolve your request and keep a reasonable record of our communications.
- Email and text lists: until you unsubscribe.
- Analytics and advertising data: according to the retention settings of our analytics and advertising providers.
Where information is stored: our store data is hosted in the United States. Some of our providers may process information in other countries, under contracts that require them to protect it.
9. Security
We use reasonable administrative, technical and physical safeguards, and our platform and payment providers encrypt payment data in transit. No system is completely secure, so we cannot guarantee the security of information sent over the internet.
10. Children
Our site is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has given us information, contact us and we will delete it.
11. Changes to this policy
We may update this policy from time to time. We will post the new version here with a new effective date, and we review it at least once a year.
